Content
iLogic Hosting servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to iLogic Hosting service agrees to indemnify and hold harmless iLogic Hosting from any claims resulting from the use of the service that damages the subscriber or any other party.
Pornography, adult content, and sex-related links or merchandising is prohibited on all iLogic Hosting servers. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.
iLogic Hosting will be the sole arbiter as to what constitutes a violation of this provision. iLogic Hosting does not host competitor sites or web pages promoting sites of its competitors.
Any deliberate attempt to cause damage to iLogic Hosting or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.
Email
iLogic Hosting servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. iLogic Hosting considers spam any mass unsolicited message in the mediums of newsgroups and e-mail. If you are found to have spammed, then we reserve the right to immediately, without warning, disable your domain. We reserve the right to refuse or cancel service to known spammers. We reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund. This is also true for sites that promote any illegal activity or content they may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited. Moreover, any site selling or promoting bulk email software, service, or addresses is forbidden.
IRC
We do not allow IRC or IRC bots to be operated on our servers.
Chat Rooms
iLogic Hosting does not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as a account option.
CGI-Scripts
Every iLogic Hosting account comes with its own CGI-bin. Please feel free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effect normal server operation or service to other iLogic Hosting customers. For the protection of all our customers, we also reserve the right to discontinue service to those customers who continue to run scripts that effect normal server operation.
Reselling of Domain Space
We currently do not offer a solution for our clients to resell domain space. Any attempt to resell domain space will result in immediate termination of hosting services without a refund of unused services.
Traffic
In the event your site will exceed it's traffic limit you will be notified via email at least 7 days in advance when possible, so you will have time to address the issue. Once you have exceeded your traffic limit your site will be automatically suspended until such time that you make arrangements with iLogic Hosting. Over limit data transfer costs are $5/gigabyte once you exceed your limit.
Server Abuse
Any attempts to undermine or cause harm to a iLogic Hosting server or customer of iLogic Hosting is strictly prohibited.
Any sub-networks of iLogic Hosting and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold iLogic Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against iLogic Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless iLogic Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with iLogic Hosting's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from iLogic Hosting's server.
Disclaimer
iLogic Hosting will not be responsible for any damages your business may suffer. iLogic Hosting makes no warranties of any kind, expressed or implied for services we provide. iLogic Hosting disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by iLogic Hosting and its employees. iLogic Hosting reserves the right to revise its policies at any time.
